Learned counsel for the petitioner has made an endorsement in the court

bundle stating that the petitioner is prepared to agitate his rights before the Civil Court, provided the Civil Court decides the Civil Suit to be filed by the petitioner un-influenced by any of the observations made by the first respondent in the impugned order dated 03.01.2026 with regard to the title of the property.

2.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of respondents 1 to 3 would submit that this writ petition can be disposed of by directing the petitioner to approach the Civil Court to redress his grievance.

learned counsel on record for the fourth respondent would submit that with regard to the title of the property, the Civil Court can decide the same un-influenced by any of the observations made by the first respondent with regard to the title in the impugned order dated 03.01.2026. However, with regard to the possession, learned counsel for the fourth respondent would submit that the fourth respondent is in possession of the property, which is disputed by the petitioner as seen from the affidavit filed in support of this writ petition.

4.This Court is not expressing any opinion on the merits of the respective

contentions with regard to the possession of the property.

5.After hearing the rival submissions, this writ petition is disposed of by directing the petitioner to approach the Civil Court to redress his grievance with regard to the title and possession of the property. Once the Civil Court entertains the suit to be filed by the petitioner, the said Civil Court shall decide the said suit with regard to the title of the property un-influenced by any of the observations made by the first respondent with regard to the title in the impugned order dated 03.01.2026. However, with regard to the possession, the petitioner as well as the fourth respondent will have to prove the same through their oral and documentary evidence placed on record before the Civil Court.

6.With the above observations, this writ petition is disposed of. Consequently, connected WMPs are closed. No costs.
