PRAYER: This writ petition is filed under Article 226 of the Constitution of India seeking for issuance of writ of Certiorarified Mandamus to call for records pertaining to the impugned refused check slip issued by the 2nd respondent vide Refusal No. RFL/Joint II Sub Registrar, Dharmapuri/136/ 2025 dated 2.12.2025 and to quash the same as illegal and consequently direct the 2nd respondent to receive and register the sale deed dated 1.12.2025 presented by the petitioner

and release the same as per the Registration act 1908 within the time frame as fixed by this Court.

The petitioner is a textile merchants’ welfare association. Intending to sell an immovable property pursuant to special resolution passed on 04.07.2025 by the members of the society, the sale deed was presented for registration. The request for registration was declined under impugned refusal check slip dated 02.12.2025.

Referring to the impugned order, learned counsel submits that it reveals complete non-application of mind inasmuch as Section 41 of the Tamil Nadu Societies Registration Act, 1975 (the TN Societies Registration Act) which relates to dissolution of a society, has been extracted. He submits that the Society continues to function and that the sale has been authorized by the members of the Society at an extraordinary general meeting held on 04.07.2025. He relies on the minutes of the said meeting and the signatures of members appended thereto.

functioning. At today's hearing, it is represented that there is no evidence that the Society has been dissolved.

In the impugned refusal check slip, reference has been made to Section 41 of the TN Societies Registration Act and the executants have been directed to approach an appropriate court for a direction to sell the property.

The petitioner has filed the minutes of the extraordinary general meeting of the members held on 04.07.2025. The members have resolved to authorize eight executive members to jointly or severally execute all documents pertaining to the sale of the property described in the said minutes. The signatures of the members are appended to the resolution. Therefore, there is no basis to conclude that the Society has been dissolved or to direct the Society to obtain a court order relating to such sale. Therefore, the impugned refusal check slip is set aside and the petitioner is permitted to re-present the sale deed for registration. If re-presented within two weeks from the date of receipt of a copy of this order, subject to fulfilment of other requirements relating to registration, the registering officer is directed to register the document within two weeks therefrom. No costs.
