In a proposed suit for a declaration that the defendants wrongfully and illegally declared the plaintiff as a wilful defaulter and for alleged damages relating thereto, the intending plaintiff has requested for leave to sue the third respondent before this Court.

In the draft plaint, it is stated that the cause of action arose in Chennai where the first and second respondents maintained business operations and where the plaintiff took a loan.

Upon examining the draft plaint and the averments in the affidavit, it appears that a substantial part of the cause of action has arisen within the jurisdiction of this Court. Therefore, this application is allowed by granting leave to the applicant to sue the third respondent before this Court. As a corollary, the Registry is directed to number the suit, if otherwise in order.
