The writ petition has been field challenging the order dated 15.10.2025 wherein petitioner/borrower was directed to make a pre-deposit of 40% of the amount of Rs.13,77,53,434/- in two instalments within the stipulated period.

It is now brought to the notice of the Court that since the order passed by the Debt Recovery Appellate Tribunal in the waiver application was not complied with by petitioner, the Debt Recovery Appellate Tribunal, by subsequent order dated 28.11.2025, has rejected the appeal.

In view of the order rejecting the entire appeal, nothing survives for further adjudication in the present writ petition. Accordingly, the writ petition is closed. There shall be no order as to costs. W.M.P.No.53229 of 2025 seeking to permit petitioners to join
