Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Certiorarified Mandamus, call for the records of the 2^nd respondent culminating in the order Bearing No 15014/(1)Appeal -07/UY/CHPA(C)/SZ-1/L&R/2022/6034 dated 26.08.2022, rejecting the Petitioner’s Appeal and the records of the 3rd Respondent culminating in the Order bearing No. V-15014/ChPT/Disc/Maj-01/UY/2022/3398, dated 03.06.2022, without proper enquiry and imposing the major punishment of removal from service, and quashed the same, and consequently to direct the Respondents to reinstate the Petitioner into service with continuity of service, back wages, all service, monetary and other attendant benefits within a time frame to be fixed by this Court.

This Writ Petition has been filed challenging the order dated 26.08.2022 passed by the second respondent and the order dated 03.06.2022,

passed by the third respondent and consequently to direct the respondents to

W.P. No.3311 of 2024 reinstate the petitioner into service with continuity of service, back wages, all service, monetary and other attendant benefits within a time frame to be fixed by this Court.

The petitioner joined as Constable in Central Industrial Security Force in the year 2013 and posed at IG Mint, Hyderabad. While he was in service, he was issued with charge memo dated 01.01.2022 by the third respondent in which, an exparte enquiry was conducted and a final order was passed on 03.06.2022 by the third respondent. Against which the petitioner preferred an appeal before the second respondent and the second respondent rejected the appeal by an order dated 26.08.2022. Thereafter, the petitioner filed revision before the first respondent on 22.09.2022. However, no order was passed. Hence, the petitioner filed the present Writ Petition with the above prayer.

The learned counsel appearing for the petitioner submits that this Court may direct the first respondent to pass orders on the revision petition filed by the petitioner within a stipulated time as fixed by this Court. He further submits that reasonable opportunity may be given to the petitioner, since the petitioner was not given any opportunity before the original authority. Page 3 of 6

respondents would submit that if the Revisional Authority was not passed any orders, opportunity will be given to the petitioner.

Heard the submissions made by learned counsel on either side and perused the materials available on record.

Having regard to the submissions made by learned counsel on either side, this Court directs the first respondent to dispose the revision filed by the petitioner after affording an opportunity of hearing and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this Order.

With the aforesaid directions, the Writ Petition stands disposed of.

Consequently, connected miscellaneous petitions are closed. No costs.
