to issue arrears of stipend to the Petitioners in terms of G.O. (Ms.) No. 335 issued by the 1st Respondent, dated 29.07.2021.

The facts and the issue for consideration are the same in both the Writ Petitions and therefore a common order is being pronounced.

The Petitioners in WP.No.13669 of 2025 are DNB Diploma graduates who were admitted under the All-India Quota as non-service candidates for the 2021–2022 academic batch and completed their course in May 2024. Their selection and examinations were conducted under the control of the 4th Respondent. At the time of admission, no requirement of compulsory bond service was disclosed. The prospectus issued by the 4th Respondent did not mention any bond obligation, and the Medical Counselling Committee (MCC) portal explicitly reflected “Not Available” under the bond status for the allotted seats. Accordingly, the Petitioners joined their respective courses in Respondents 5 to 9 institutions. As a mandatory condition of admission, the Petitioners submitted their original certificates to the respective colleges. Nearly a year after commencement of the course, in February 2023, the Petitioners were compelled to execute predated bond agreements requiring them to serve the 1st Respondent for a period of two years upon completion of the

course. This condition was imposed retrospectively without prior notice or disclosure. The Petitioners, under coercion and apprehension of discontinuation of their courses, signed the bonds.

Subsequently, even before completion of the course, the 3rd Respondent issued compulsory bond posting orders dated 14.03.2024, directing the Petitioners to report for duty at various Government hospitals within seven days. These orders were issued while the Petitioners were still undergoing training and had not completed their clinical examinations, rendering compliance impracticable. Aggrieved by the same, some of the Petitioners submitted representations to the 4th Respondent. In response, the 4th Respondent, by email dated 06.06.2024, clarified that bond conditions cannot be enforced for the 2021 admission batch if such details were not uploaded on the MCC portal prior to NEET-PG counselling. Despite the said clarification, Respondents 2 and 3 continued to insist on compliance with the bond service and threatened coercive action. Under protest and apprehension, most of the Petitioners had joined the postings.

Thereafter, Legal notices were issued by the Petitioners seeking exemption from the bond obligation. Pursuant thereto, the 2nd Respondent

issued a letter dated 14.08.2024 calling for relevant records from the institutions, however, no further action has been taken. The Respondent institutions continue to unlawfully retain the original certificates of the Petitioners, thereby preventing them from pursuing higher education or securing employment. In some cases, Petitioners were compelled to either forgo opportunities or incur substantial financial burden.

The 4th Petitioner, previously in service under the Bihar Government,

has been relieved but is unable to rejoin due to the non-release of certificates. The 5th Petitioner was forced to pay Rs. 20,00,000/- towards the bond to secure the release of certificates and could join employment at ESI Hospital, Noida only in January 2025. Further, as per G.O. (Ms.) No. 335 dated 29.07.2021, the stipend for PG Diploma students was revised to Rs. 45,000/- (first year) and Rs.47,500/- (second year). However, the Petitioners were paid only Rs. 35,000/during their first year, and the revised stipend was implemented only in the second year. The arrears for the first year remain unpaid.

In these circumstances, the Petitioners would submit that the retrospective imposition of bond service, unlawful retention of original certificates, non-payment of stipend arrears, show cause notice dated

27.06.2025 (in WP.No.27118 of 2025) and the coercive actions of the Respondents are arbitrary, illegal, and violative of their fundamental rights under the Constitution of India, thereby constraining the Petitioners to file the present Writ Petitions.

The petitioner is WP.No.27118 of 2025 who is also one of the petitioners in WP.No.13669 of 2025, during the pendency of this Writ Petition has been issued with a show cause notice dated 27.06.2025 requiring her to either report for duty or pay a sum of Rs.20,00,000/- towards the bond amount failing which she has been threatened with coercive action. Therefore, she has filed the above Writ Petition to quash this Show Cause Notice.

The 1^st , 2^nd , 3^rd , 5^th to 9^th respondents and the 4^th respondents have filed their respective counters in WP.No.13669 of 2025 alone. The 4^th Respondent in W.P. No. 13669 of 2025 had filed a counter affidavit contending that they are in

no way connected with the implementation of the bond service or the retention of original certificates, and that no relief has been sought by the Petitioners against the 4th Respondent. They have however contended that through their email dated 24.04.2024 and 06.06.2024, they have informed the medical college

that service bond cannot be applied to the trainees of 2021 admission session

since the service bond details were not uploaded on the MCC Portal by the

participating individual hospital prior to the start of the NEET PG counselling.

¶110

The 2^nd Respondent in W.P. No. 13669 of 2025 had filed a counter affidavit for self and on behalf of respondents 1, 3, 5 to 9 stating that for the academic year 2021–2022, when the MCC conducted counselling for the DNB course for the first time, it issued a notification dated 15.09.2021 directing all States to upload their seat matrix along with details of any bond obligation. At the relevant point in time, no policy decision regarding bond service had been taken by the State Government; consequently, no such details were uploaded. The State Government subsequently took a policy decision to implement bond service only on 03.01.2022, by which time the MCC had already frozen the seat matrix, making it impossible to upload the bond details. It is submitted that a similar situation prevailed across other States, and accordingly, the MCC portal for the said academic year reflected only the seat matrix and did not display bond status for any institution.

The 1st Respondent would further submit that the MCC, in its Information Bulletin and Counselling Scheme for the year 2021, has categorically stated in Clauses 2.10 and 2.13 of Chapter 2 that, in case of any

discrepancy or doubt regarding stipend, fee structure, course duration, bond amount, rendering of service in rural/tribal areas, or other conditions, the same shall be governed as follows:-

“2.10 The information regarding Stipend /fee structure/ course duration /

bond amount /rendering of service in rural / tribal area/other conditions etc. has been provided by Medical Colleges. MCC/ DGHS takes no responsibility regarding the above information including Fees/ Bond/ Mode of Payment or any typographical error/data ete. Candidates are advised to visit College website or contact the College Authorities directly for any query regarding above information before filling choices. Choices once locked cannot be modified and any request to MCC/DGHS regarding tinkering of choices will not be entertained.”

“2.13 The information regarding Stipend /fee structure/ course duration /

Choices once locked cannot be modified and any request to MCC/DGHS regarding tinkering of choices will not be entertained.”

The 1^st respondent would further submit that as per Clause 32(h) of the Prospectus issued by the Government of Tamil Nadu for admission to DNB Broad Specialty courses for the year 2021, non-service candidates selected through the 50% NBE quota were required to execute a bond with three sureties for a sum of Rs. 20,00,000/-, undertaking to serve the Government of Tamil Nadu for a minimum period of two years. The said prospectus was duly available on the websites of the concerned colleges and the Directorate of Medical Education and Research. Therefore, the Petitioners were fully aware of the compulsory bond requirement and having executed the bonds at the time of joining and pursued their course of study thereunder, cannot now be permitted to question the same. With reference to the payment of the stipend the respondents would contend that proceeding to provide stipend arrears have been released.

The learned counsels on either side have canvassed their case on the same lines as contended by them in their respective pleadings. Ms.Sneha, learned counsel appearing for respondents 1 to 9 in WP.No.13699 of 2025 would place reliance on a Division Bench judgement of this Court in a Batch of Writ Petitions and Writ Appeal with the lead case being WA.No.799 of 2019.

Heard the learned counsel on either side and perused the records.

¶129

The issues which engage the attention of this Court are:-

¶130

(a) Whether the petitioners who were initially given to understand that they did not have to fulfill the bond period can be compelled to undergo the same?

¶131

(b) Whether the respondents can rely upon clause 2.10 and 2.13 in Chapter 2 of the NEET PG (MD/MS/DNB/MDS) Counselling Information Bulletin and Counselling Scheme to compel the petitioner to complete the Bond period?

The petitioners rest their case on the fact that at the time of applying for the course the prospectus issued by the 4^th respondent and Medical Counselling Committee (MCC) portal indicated “Not Available” under the Bond Status. That apart, citing the Service Bond the original certificates of the petitioners are being retained by the respective institutions and that they are not being paid the revised stipend. The defense to this contention is that in the Information Bulletin and the Counselling Scheme for the year 2021 in Clause 2.10 and 2.13 of Chapter 2 clearly instructed the candidates to visit the college authorities for information with regard to details regarding stipend, fees

structure, course duration, bond amount, rendering of service in rural/tribal areas or other conditions.

¶137

To appreciate the rival submissions, it would be useful to refer to certain dates and events

¶138

23.02.2021: - Prospectus for admission to Post MBBS, DNB and NBE Diploma Counsel – 2021 session issued by the 4^th respondent. (Non-Service Candidates)

¶139

15.09.2021: - MCC issues notification for conducting counselling for the

¶140

first time for DNB Course for the year 2021-2022. Prior to this counselling for DNB was conducted by the Directorate of Medical and Rural Health Services,

¶141

the 2nd respondent.

¶142

29.07.2021 :- G.O.Ms.335 issued by 1st respondent enhancing monthly

¶143

stipend to PG diploma students to Rs.45,000/- for 1st year and Rs. 47,500/- for 2nd year.

¶144

28.11.2021 :-Prospectus issued for admission to DNB Broad Speciality

¶145

Post MBBS and Post Diploma and post MBBS two year Diploma Course for service candidates 2021 session.

2022 :-. Petitioners enrolled in the DNB courses under the All India

¶150

Quota. At the time of applying, the Medical Counselling Committee Portal for all the colleges had displayed the Bond Status as “Not Available”.

In the counter filed by the 2^nd respondent it has been admitted that at the time of the counselling the State Government had not taken a decision with respect to the Bond and therefore the same could not be uploaded. In paragraph no. 4 of the counter they have stated as follows: -

“It is Humbly submitted that as stated above, when the MCC conducted the counselling for DNB course for the first time for the year 2021-2022, MCC had issued notification dated 15.09.2021 to all Government colleges throughout India with respect to it conducting counselling and further directed the states to register their seat matrix along with the bond if any. The State Government had registered its seat matrix and with respect to bond, since as on that date, the decision was not taken by the State Government, the same could not be uploaded. Subsequently only on 03.01.2022 the State Government had taken a policy decision to implement the bond service. Before that the MCC had froze the seat matrix and therefore the same could not be uploaded. Similar was the case with respect to all other states in India. The MCC portal for the academic year 2021-2022 would only show the seat matrix and will not show the bond

status for any institution across India.”

In their counter affidavit, the 4th respondent have also submitted the following with reference to the bond status: -

“4. It is seen that the Petitioners were made to submit their Original Certificates with the Respondent colleges and also sign a pre dated bond stating that they will serve the 1ª Respondent for a period of two years. In this regard, pursuant to the complaints received from trainees and the Petitioner regarding

implementation of Service Bond at Government Medical College, Ramanathapuram, Tamil Nadu, Accreditation Department of NBEMS informed Government Medical College, Ramanathapuram, Tamil Nadu through email dated 24.04.2024 and 06.06.2024 that, "Service Bond cannot be applied to the

trainees of 2021 admission session if the details of Service Bond were not uploaded on MCC portal by the participating individual hospital prior to start of NEET PG counseling.”

Therefore, it is clear that the respondents 1 and 2 had not taken any decision regarding the Bond status prior to the start of the NEET PG counselling. Therefore, the contention of respondents 1 and 2 that the petitioners ought to have followed the instructions in Clause 2.10 and 2.13 of Chapter 2 of the Counselling Scheme cannot be accepted as even according to them the decision with reference to the service Bond was taken later in point in time. If the Bond status had indicated that the applicants would have to undergo

a Bond period the petitioners, some of whom are already serving under other State Governments would have chosen otherwise. The argument of the Respondents that the petitioners have later signed a Bond cannot be considered as this Bond has been obtained under compulsion as the petitioners were required to sign the Bond when they were a year into the course. Further, all the documents of the petitioners were in the custody of respondents 1 and 2.

The petitioners in their affidavit filed in support of the Writ Petitions have stated as follows:-

WP.No.13669/2025 – 5. While so, in February 2023, nearing a year after the course commenced, we were unexpectedly required to sign a predated bond stating that we will serve the 1st Respondent for a period of two years upon completion of our course. This came as a shock to us since we were not informed of any such requirement while joining the course. Moreover, we were required to give the said undertaking nearly one year after the commencement of the course. This requirement, imposed retrospectively, was in violation of due process. The Petitioners, fearing discontinuation of their courses, had no option but to sign the bond. We still believed that the bond was a mere formality and the same would not be enforced against us.

WP.No. 27118/2025. - 5. However, in March 2024, even before the

completion of my clinical examinations, I was issued a bond posting order dated 14.03.2024 requiring me to join the Government Hospital, Madathukulam

¶173

in Tiruppur District within seven days. This posting order was issued while I was still in the process of completing my post-graduation diploma course. In such circumstances, notwithstanding the fact that the posting order was illegal, it was impossible for me to join the postings within a week's time.

This contention of the petitioners has not been denied by the respondents 1 and 2. That apart, the judgement relied on the side of the respondents does not apply to the facts of the instant case as in that case the prospectus had clearly spelt out the Bond condition.Therefore, both the issues have necessarily to be answered in favour of the petitioners.

As regards the non-payment of stipend to the petitioners, in their counter affidavits respondents 1 and 2 had stated as follows-

“It is submitted that Diplomate of National Board courses has been started in the (2018-2019) at Government District Headquarters Hospitals & Taluk Hospitals in Tamil Nadu. The stipend for the DNB candidates has been fixed as per the Government order (Ms) No.307, Health and Family Welfare

It is submitted that revised stipend for DNB candidates has been obtained on par with non-service candidates pursuing Post-graduation course i.e. MD/MS candidates in Government Medical Colleges, Private Medical Colleges and revised as per the Government Order (D) No. 98, Health and Family Welfare (MCA-2) Department, Dated: 25.01.2023 with effect from 29.07.2021 to till date. with 3% annual increment after completion of every year.

The National Health Mission, Tamil Nadu has released the proceeding to provide the stipend arrears for all the 368 DNB candidates who pursued DNB courses from the period 2019 - 2023 as per the above said Government Order. Proc. No. 879/NHM/DNB/P18/2023 - Dated: 30.12.2025.”

(a) WP NO. 27118 of 2025 is allowed and the Show cause notice dated
