These writ petitions have been filed to direct the respondents to pay the amount towards the outstanding Dearness Allowance along with 18 percent per annum interest for the belated period of payment to the petitioners within a time limit.

The brief facts which has culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioners that at the time of retirement, they

were working as "Senior Tradesman" in the Respondent Corporation. It is the contention of the petitioners that the respondent has failed to pay the revised Dearness Allowance from 01.01.2011 till the date of their retirements.

2.2. He further submits that retirement benefits were also to be disbursed

taking note of the said revision in Dearness Allowance. However, the said revised Dearness Allowance was not taken into consideration while calculation their retirement benefits.

The petitioners have made representations to the respondent to pay them the differential payment with interest. However, the same had not been considered to date by the respondent. Hence, the petitioners are before this Court.

Heard the learned Counsel on either side and perused the records.

Considering the limited request of the petitioners and taking note of the

fact that the petitioners’ representations have not been considered to date by the Respondent, a mandamus, is therefore, issued to the respondent to pay the differential sum of Gratuity and Leave Encashment benefits to the petitioners based on Dearness Allowances revision with effect from 01.01.2011, from the said date of entitlement till the date of actual disbursement along with 6% interest per annum, within a period of twelve (12) weeks, from the date of receipt of a copy of this order.
