The petitioner has sought a mandamus to the respondents to discharge him from the Charge Memo dated 05.01.2017 in the light of a similarly placed person having been granted the same relief, and to disburse her terminal benefits.

The petitioner would submit that he was appointed as Junior Assistant in 2003 on consolidated pay and was later was regularised in 2009 after clearing TNPSC (Special Test) in the year 2009. Thereafter, she was promoted as Assistant in 2012. She retired from service on 31.05.2022. A charge memo was issued to her in 2017 along with other officials alleging fraudulent encashment of a cheque for Rs.3,00,000/under the Chief Minister Uzhavar Pathukappu Thittam. The petitioner would submit that she was not dealing with the concerned scheme and had

no connection with the alleged transaction. She would further submit that the Police Department closed the case by filing a Further Action Dropped

(FAD) report for want of evidence. However, her pension and other

retirement benefits have not been settled due to the pending disciplinary proceedings. Therefore, the petitioner has filed the present writ petition seeking the aforesaid relief.

Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents.

A perusal of the records would indicate that the basis upon which

the Charge Memo had been issued was that the petitioner and others had forged the signatures on the subject cheque and misappropriated the amount. A co-accused by name R. Govindarajan had the Charge Memo issued to him dropped on the ground that the charges had not been proved. It is reported that insofar as the co-deliquent is concerned, the 1^st respondent has passed an order taking into consideration the Further Action Dropped report dated 30.04.2019 submitted by the Inspector of Police, District Crime Branch, Krishnagiri. Further, the Inspector of Police, District Crime Branch, Krishnagiri, by his letter dated 25.05.2022, submitted a report to the 1^st respondent wherein he stated as follows:
