PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for a writ of Certiorari:

(i) Call for the records relating to the provisional assessment and its Statutory required documents, all internal independent validation and Verification done by chain of authority, inquiry proceedings recorded in minutes dated 30.08.2025 on petitioner’s original petition before the department bearing No.169 dated 17.06.2025 read with the official communication by 5th Respondent dated 23.09.2025 in Lr. No.AEE/ O and M/ TKM/ CEDC/ F-TOE/ DNo.211/2025 and (ii) To direct the Respondents to refund the penalty sum of Rs.92,646/- paid by the Petitioner with interest at 12 percent p.a. from 27.05.2025, the date of the provisional report filed by the respondents.

The present writ petition is filed challenging the inquiry proceedings recorded in minutes dated 30.08.2025 and to direct the respondents to refund the penalty paid by petitioner along with interest at 12% per annum from 27.05.2025, i.e., the date of provisional report filed by the respondents.

After submitting for a brief while, it was pointed out by the learned

counsel for respondents that what is submitted is only a provisional assessment and if the petitioner were to submit any reply/ representation, the same would be considered by the respondents before passing the final order. To which, learned counsel for petitioner sought liberty to file his reply/ representation within a period of two weeks.

In that view of the matter, in case any reply/ representation is submitted by the learned counsel for petitioner within a period of two weeks from the date of uploading of web copy of order without waiting for receipt of certified copy, the same shall be considered by the respondents and appropriate orders shall be passed on merits and in accordance with law, after affording a reasonable opportunity of hearing to the petitioner before passing final orders. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
