This Writ Petition has been filed to quash the order dated 24/7/2025 passed by the Labour Court, Kanchipuram in I.A.No.1 of 2025 in I.D.No.125 of 2021 and consequently, allow I.A.No.1 of 2025 in I.D.No.125 of 2021 and direct the Labour Court, Kanchipuram to number the set aside application bearing I.A.SR.No.76 of 2025 in I.D.No.125 of 2021 and dispose of the same on merits.

Heard Mr.K.Navod Prasannan, learned counsel for the petitioner.

I.A.No.1 of 2025 in I.D.No.125 of 2021 was filed by the petitioner

before the Labour Court, Kanchipuram, to condone the delay of 939 days in filing petition to set aside the ex parte final order dated 30/5/2022 passed in I.D.No.125 of 2021. On 17/7/2025, orders were passed directing the petitioner to pay the cost of Rs.5,000/- to the respondent on or before 24/7/2025 failing which the said petition would be dismissed. On 24/7/2025, orders were pronounced dismissing the petition since there was no representation till 4.45 p.m., and cost was not paid.

The present writ petition was filed mainly on the ground that orders in

aware of imposition of costs on the petitioner. This Court, by an order dated 23/6/2026, directed the labour Court to inform as to why the order copy was not

uploaded. After receipt of the said communication, order was uploaded.

Since the impugned order was not uploaded, till explanation was

sought for by this Court, the non-payment of costs cannot be attributed to the petitioner. Accordingly, order dated 24/7/2025 passed in I.A.No.1 of 2025 in I.D.No.125 of 2021 is set aside and the writ petition is allowed . The petitioner shall approach the labour Court, Kanchipuram, on or before 22/7/2026 to pay the costs, pursuant to which I.D., shall stand restored to the file of the labour Court, Kanchipuram. No costs. Consequently, connected Miscellaneous Petitions are closed.
