PRAYER The writ petition filed under Section 226 of the Constitution of India, seeking to issue a writ of mandamus, directing the 2^nd respondent herein to consider the application dated 24.05.2017 for issuing orders for late registration of the petitioner’s father death and pass appropriate orders thereon at the earliest point of time as may be fixed by this Court.

This writ petition has been filed seeking a direction to the 2^nd respondent herein to consider the application dated 24.05.2017 for issuing orders for late registration of the petitioner’s father death.

The case of the petitioner is that his father Munusamy Gounder died on 05.07.2006 on account of age related illness, at the ripe old age of 88. The petitioner is one among the children of late Munusamy Gounder who had left behind his properties in which the petitioner is also entitled to a share. In order

to claim a share, the petitioner is bound to produce a legal heirship certificate and the death certificate of his father. However, the death of his father, had not been registered till date. The petitioner has therefore filed an application on 24.05.2017, along with requisite documents and fees. He was called for an enquiry on 17.05.2018, during which the petitioner had produced two witnesses and affidavits. However thereafter no further orders have been passed. Therefore the petitioner is before this Court.

Heard the submissions advanced by the learned counsel on either side and perused the records available on record.

A perusal of the records would show that on the application submitted

by the petitioner on 24.05.2017, the petitioner had received summons for

appearance on 17.05.2018 at 3 P.M., The summons is dated 30.04.2018 and the

¶30

enquiry was also conducted and the petitioner also submitted two witnesses and affidavit. However, to date the second respondent has not passed orders in the said matter. Nearly eight years have passed since the enquiry. Therefore this Court is inclined to pass the following order:

i. the second respondent is directed to conduct fresh enquiry on the application of the petitioner dated 24.05.2017, after hearing the petitioner afresh;

ii. Thereafter pass appropriate orders on merits and in accordance with law, within a period of one month from the date of receipt of a copy of this order.
