This Writ Petition has been filed to direct the respondents to refer the matter for enhancement of compensation to the concerned Civil Court based on the petitioner’s representations dated 24.03.2026 and 08.04.2026.

Learned counsel for the petitioner submitted that the petitioner is the owner of the agricultural punja dry lands at No.96, Sirukundram Village, Chengalpattu District, measuring an extent of 9 acres 76 cents. The petitioner received a notice dated 09.06.2023 issued by the 3^rd respondents regarding the proposed acquisition of 20,426 sq.m, and was called upon to submit his objections. Accordingly, the petitioner submitted his written objections to the proposed acquisition. Subsequently, notice under Section 15(1) of Tamil Nadu Highways Act, 2001 was issued by the competent authority and published in the Government Gazette vide G.O.Ms.No.53 (extraordinary) dated 21.02.2024, for the purpose of construction of highways under Chennai Peripheral Ring Road Scheme. The awards were also passed on 10.10.2025.

It is further submitted that the awards were passed without considering the prevailing market value of the land or the representations submitted by the petitioner and that the compensation determined by the authorities is grossly inadequate, meagre and unreasonable. On 26.02.2026, a sum of

Rs.9,11,60,663/- being the award amount was transferred through NEFT to the petitioner’s Bank Account. Being not satisfied with the award amount, the petitioner submitted a representation dated 18.03.2026 to the 3^rd respondent to

take necessary action to refer the matter to the concerned Civil Court to enable the petitioner to establish his right for enhancement of compensation under the provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. As no action was taken, the petitioner submitted a further representation dated 08.04.2026 seeking the very same relief. Though the representations dated 18.03.2026 and 08.04.2026 were received by the respondents, no orders have been passed thereon. Hence, the petitioner has filed this writ petition.

In reply, learned Government Counsel submitted that the matter would be referred to the competent Civil Court for determination of enhanced compensation.

Having heard the submissions on either side and perused the materials available on record, this Court is of the view that the 3^rd respondent shall refer the matter to the competent Civil Court viz., The Principal District Judge, Chengalpet, for determination of enhanced compensation, within a period of four weeks from the date of receipt of a copy of this order.
