PRAYER : Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the first respondent to consider the petitioner’s representation dated 16.03.2026 requesting for payment of the retirement benefits that have not been paid to the petitioner and payment of interest on the belated payment of the retirement benefits as stated in the said representation.

It is the case of the petitioner that he was appointed as Police Constable Grade II on 01.05.1988 and promoted as Sub Inspector of Police on 30.10.2004. Due to pendency of a criminal case, he was placed under suspension with effect from 28.02.2019. After the dismissal of the said criminal case, his suspension order was revoked and he was permitted to retire with effect from 28.02.2019 and his suspension period was treated as duty under FR 54(B) vide order dated 23.07.2025. Despite the above orders, the petitioner had not received his terminal benefits so far.

Aggrieved by the same, the petitioner made a representation dated 16.03.2026 requesting payment of the unpaid benefits together with interest on all belated payments, for which, there is no response till date. Therefore, the petitioner is before this Court.

Heard the learned counsel on either side and perused the materials available on record.

Considering the relief now sought for by the learned counsel for the

petitioner, this Court, without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 16.03.2026, on merits and in accordance with law and to pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No costs.
