This writ petition has been filed to direct the third respondent to register

the sale deed dated 26.12.2024 presented by the petitioner for registration.

According to the petitioner, the sale deed presented by the petitioner was not registered by the third respondent. It is the petitioner’s case that there is no legal impediment for the third respondent to register the sale deed presented by the petitioner for registration. The petitioner categorically contends before this Court that the third respondent does not have the power to adjudicate the title of the property.

Admittedly, a protest petition has been filed by the fourth respondent before the third respondent, objecting to the registration of any document pertaining to the property, which is the subject matter of the sale deed presented by the petitioner for registration. When a protest petition has been filed, the objector viz., the fourth respondent will have be put on notice and heard by the third respondent before a final decision is taken as to whether the sale deed presented by the petitioner can be registered or not. However, the third respondent does not have the power to go into the title of the respective parties.

For the foregoing reasons, this Court directs the third respondent to take a final decision as to whether the sale deed dated 26.12.2024 presented by the petitioner can be registered or not within a period of four weeks from the date of receipt of a copy of this order.
