ORDER

This writ petition has been filed challenging the impugned notice issued by the 1^st respondent dated 25.03.2023, calling upon the petitioner to participate in the enquiry proceedings initiated based upon the application submitted by the 2^nd respondent, seeking for cancellation of patta issued in favour of the petitioner for the property more fully described in the affidavit filed in support of this writ petition.

2.The petitioner has approached this Court even before a final decision has been taken by the 1^st respondent, on the 2^nd respondent’s application, seeking for cancellation of petitioner’s patta. The petitioner contends that she is the absolute owner of the property more fully described in the affidavit filed in support of this writ petition. She has also filed the documents in support of her

contention. However, the same has been disputed by the 2^nd respondent, as seen from the 2^nd respondent’s representation to the 1^st respondent seeking for cancellation of petitioner’s patta.

3.Necessarily the petitioner will have to participate in the proceedings of the 1^st respondent initiated based on the 2^nd respondent’s representation, seeking for cancellation of petitioner’s patta. All the objections that have been raised by the petitioner before this Court through this writ petition can very well be raised by the petitioner before the 1^st respondent. Instead of raising the said objections before the 1^st respondent, the petitioner has approached this Court prematurely by filing this writ petition without waiting for the final decision of the 1^st respondent on the 2^nd respondent’s representation.

4.Since this writ petition has been filed prematurely without waiting for the 1^st respondent’s final decision, the petitioner is directed to participate in the proceedings initiated by the 1^st respondent pursuant to the 2^nd respondent’s representation, seeking for cancellation of patta, by raising all the objections before the 1^st respondent including the written objection that necessarily the 1^st respondent will have to consider on merits and in accordance with law, after giving due consideration to the supporting documents filed by the petitioner to substantiate the petitioner’s contention that the 2^nd respondent is not entitled for cancellation of petitioner’s patta.

5.This Court is not expressing any opinion on the merits of the

contentions made by the respective parties.

6.In the result, this writ petition is disposed of by directing the petitioner to submit her written objection with regard to the 2^nd respondent’s representation seeking for cancellation of petitioner’s patta for the property more fully described in the affidavit filed in support of this writ petition, within a period of two (2) weeks from the date of receipt of a copy of this Order. On receipt of the said objection from the petitioner within the stipulated time, the 1^st respondent shall give a due consideration to the said objection; supporting documents as well as the contentions of the 2^nd respondent and pass final orders on merits and in accordance with law, within a period of twelve (12) weeks thereafter. The 1^st respondent shall also furnish the petitioner with the copy of the representation given by the 2^nd respondent seeking for cancellation of petitioner’s patta. No

costs. Consequently, connected miscellaneous petitioners are closed.
