Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of a writ of mandamus to direct the respondents to consider and pass orders on the petitioner’s representation dated 3.12.2025 for grant of final building approval within a time frame to be stipulated by this court.

This writ petition has been filed seeking for a direction to the respondents

¶19

to grant final building plan approval in respect of the petitioner’s building, based on their representation dated 03.12.2025, within a time frame to be fixed by this Court.

The petitioner claims that as per G.O.Ms.No.169, Industries (MIE2) Department, dated 12.09.1996, the petitioner is entitled to put up construction even before the grant of approval by the respondents. According to the petitioner, they have commenced construction and simultaneously, they had sought for approval from the respondents in respect of their building. They had also given a representation dated 03.12.2025 to the respondents seeking for the grant of final building plan approval. However, according to the petitioner, till date, the respondents have not granted final plan approval in their favour. In such circumstances, the petitioner has filed this writ petition.

Mr.Shajahan, learned Special Government Pleader, accepts notice on behalf of the respondents.

No prejudice will be caused to the respondents if the aforesaid representation of the petitioner is considered on merits and in accordance with

law, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of by directing the respondents to pass final orders on merits and in accordance with law, on the petitioner’s representation dated 03.12.2025

seeking for grant of final building plan approval in their building after giving due consideration to the supporting documents filed by them along with their plan application, within a period of 12 weeks from the date of receipt of a copy of this order. This Court is not expressing any opinion on the merits of the aforesaid representation of the petitioner. No Costs.
