Review Applications have been instituted seeking review of the common

¶37

order passed by this Court on 05.01.2018 in a batch of writ petitions instituted challenging the orders of the Central Administrative Tribunal dated 11.03.2016 in Original Application.

BSNL issued a circular dated 30.11.1992, addressed to all Head of Circles/Administrative Offices that SC candidates who have atleast secured 20 marks and ST candidates who have alteast secured 15 marks can be considered as successful, and also the Official Memorandum dated 03.10.2000 issued by the Department of Personnel and Training directing all the departments to follow the relaxations/concessions in matters of promotion for candidates belonging to SCs/STs by way of lowering qualifying marks, and to adopt lesser standards of evaluation which was in existence prior to 1997.

Central Administrative Tribunal directed the authorities to consider the case of the applicants subject to their eligibility and other criteria fixed. The said order came to be challenged before the High Court. Division Bench, while affirming the order of the Central Administrative Tribunal, reiterated by directing the Department to consider the case of the applicants in view of the Circular dated 28.07.2016. Therefore, it is for the department to consider the cases based on the circulars. Such a direction cannot be construed as an error apparent warranting interference by exercise of powers of review by this

Court. Department is expected to consider the cases as expeditiously as possible.

Accordingly, Review Applications stand dismissed . In view of the order passed in Review Applications, the contempt petition stands closed . Consequently, the connected miscellaneous petitions, if any, are closed.
