This Civil Revision Petition (CRP) has been filed challenging the order

dated 04.02.2026 passed by the IV Additional District Judge, Ponneri, in I.A.No.5 of 2025 in O.S.No.38 of 2023. In the aforesaid order, the application

filed by the petitioner/second defendant to reject the first respondent/plaintiff’s marking of unstamped documents, namely, Exs.A2 to A5 in O.S.No.38 of 2023

has been dismissed, by granting liberty to the petitioner to raise all his objections during the cross-examination of PW1, and it was further made clear

that such objections would be considered at the time of appreciation of evidence in the main suit.

Admittedly, Exs.A2 to A5 have already been marked as exhibits on the side of the plaintiff by the trial Court. Only thereafter, the second defendant has filed I.A.No.5 of 2025 seeking to reject the documents, namely, Exs.A2 to A5 marked on the side of the plaintiff. The trial Court, under the impugned order, has rightly not entertained I.A.No.5 of 2025 filed by the petitioner/second defendant by holding that the petitioner/second defendant is permitted to raise all his objections during the cross-examination of PW1 and such objections would be considered at the time of appreciation of evidence in the main suit.

The documents in question, namely, Exs.A2 to A5 have already been marked on the side of the plaintiff by the trial Court, subject to their admission, proof and relevancy. The interest of the petitioner has been adequately protected through the impugned order passed by the trial Court. Therefore, the question of interfering with the impugned order through this CRP does not arise. Accordingly, this Civil Revision Petition is dismissed as devoid of any merit. No Costs. CMP.No.9373 of 2026 is closed.
