This case came up for settlement before the Lok Adalat. Both the parties present. The counsel for the petitioner Mr.T.Lenin Kumar and the respondent/in-person are present. This Criminal Revision Case is preferred against the judgment delivered by the learned I Additional District and Sessions Judge, Trichy, made in Crl.A.No.68 of 2021, dated 12.07.2022 confirming the judgment passed by the learned District Munsif cum Judicial Magistrate, Srirangam in S.T.C.No.358/2019, dated 20.10.2021.

The learned District Munsif cum Judicial Magistrate, Srirangam,

has convicted the revision petitioner and sentenced him to undergo six months Simple Imprisonment for the offence under Section 138 of N.I.Act and directed to pay a sum of Rs.7,12,000/- (Rupees Seven Lakhs and Twelve Thousand only) within a period of one month under Section 357(3) of Cr.P.C, and in default to undergo 3 months Simple Imprisonment and the same was confirmed by the learned I Additional District and Sessions Judge, Trichy. Aggrieved by the same, the present Criminal Revision Case has been filed before this Court.

Both parties are present today. Upon negotiation, the parties have agreed to amicably resolve the dispute. Accordingly, the defacto

complainant has agreed to compound the offence upon receipt of a sum of Rs.1,26,000/- (Rupees One Lakh and Twenty-Six Thousand only) from the petitioner/accused on or before 31.08.2026. The remaining amount of Rs.3,00,000/- (Rupees Three Lakhs only) shall be paid in six monthly installments of Rs.50,000/- (Rupees Fifty Thousand only), payable on or before the 20th day of each English calendar month, commencing from 20.10.2026. It is further brought to the notice of this Court that a sum of Rs.2,86,000/- (Rupees Two Lakhs and Eighty-Six Thousand only) has already been deposited before the Trial Court and the de facto complainant is permitted to withdraw the said amount.

Since the petitioner/accused has been convicted in this case, after making payment, the matter shall be posted before the regular Court for setting aside the conviction and sentence passed by the learned I Additional District and Sessions Judge, Trichy.

This Lok Adalat award is passed in terms of the above settlement.

The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamilnadu Court Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.

The Original of the award shall be place in the court record and copy of the award, kept with High Court Legal Services Committee and one copy each is furnished to both parties free of cost.

In agreement of the above, both parties and their counsel have affixed their signatures/ thumb impressions in presence of the Lok Adalat Bench admitting the terms and today conditions and accordingly, the award is passed.
