date of occurrence, the defacto complainant alogn with his brother had gone to Manimuthar Canal for taking bath. At that time, the petitioner along with other accused persons way laid the defacto complainant and abused the defacto complainant in filthy language and also assaulted him with

The learned counsel for the petitioner

would submit that the petitioner is an innocent person and he was falsely implicated in this case and he is no way connected in the above said incident. He would further submit that there was a family dispute pending between the parties. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Additional Public Prosecutor

appearing for the respondent Police would submit that the investigation is pending and the offences are grave in nature and the injured person has been discharged from the hospital and the petitioner has no previous cases. However, he opposes to grant anticipatory bail to the petitioner.

Heard both sides and perused the materials available on record.

Considering the rival submissions on either side and the nature of offences charged against the petitioner and there was a previous family dispute between the parties and the material part of the investigation might have been completed and also considering the fact that the injured person has been discharged from the hospital and the petitioner has no previous cases, I am inclined to grant anticipatory bail to the petitioner, subject to the following conditions:

ordered to be released on anticipatory bail on condition to execute a bond for a

sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Judicial Magistrate Court, Ambasamudram,
