O R D E R

This petition has been filed to quash the entire proceedings in C.C.No.87 of 2023 on the file of the learned Judicial Magistrate, Tiruttani.

2. While pending this petition, the second respondent and the first petitioner entered into a compromise in HMOP.No.4 of 2024 and accordingly, the marriage solemnized between the first petitioner and the second respondent on 01.11.2019 was dissolved by mutual consent.

3. The terms and conditions of the mutual divorce are as follows:-

“ The parties here to confirm and declare that they have voluntarily and of their own free will arrived at this Statement Agreement in the presence of the Mediator/Conciliator.

a) The party of the 2 nd part namely the wife has that she has no objection to allow the above petition CRP.No.3330/2023 to quash the DVC Petition No.3/2023 pending before Judicial Magistrate, Tiruttani.

b) The parties of 1 st part agrees to withdraw HMOP.No.12/2023 pending before Sub Judge, Tiruttani.

c) The 1 st party, husband agrees to pay a full and

final settlement of Rs.35,00,000/- out of which Rs.15,00,000/- to the wife towards permanent alimony and Rs.20,00,000/- to the minor child namely Pragadesh at the time of taking evidence in mutual consent.

d) The party of the 1 st part shall deposit a sum of Rs.20,00,000/- in the name of minor child Pragadesh. The 2nd party wife is entitled to withdraw the monthly interest up to the age of majority of minor son.

e) The custody of the minor child will be with the nd wife the party of the 2 part.

f) The party of the 2 nd part agrees has no objection to the quash filed against C.C.No.395/2022 pending before Judicial Magistrate, Tiruttani in Crl.O.P.No.25982/2023.”

4. Accordingly, HMOP.No.4 of 2024 was decreed by the judgment

and decree dated 26.03.2024.

¶36

5. As per one of the terms and conditions, the second respondent

has no objection to quash the proceedings in this petition.

6. In view of the settlement arrived at between the first petitioner

¶39

and the second respondent, the entire proceedings in C.C.No.87 of 2023 on the file of the Judicial Magistrate Court, Tiruttani is quashed.

7. Accordingly, this Criminal Original Petition is allowed.
