Bail-condition modification refused - The High Court of Judicature at Madras (C.Kumarappan, J.), by order dated 02-06-2026 in CRL OP No. 13656 of 2026 filed under Section 528 of BNSS, dismissed the petitioner's application seeking modification of condition (i) in Crl M.P. No.549 of 2026 dated 27-04-2026 of the Judicial Magistrate, Ambattur, which required the petitioner/accused (Crime No.716 of 2025, T-3 Korattur Police Station) to execute a bond for Rs.10,000/- with two sureties for a like sum each and to appear before the respondent police daily at 10.00 a.m. for 15 days. Counsel submitted that in the other case (Cr.No.140 of 2025) the Judicial Magistrate, Sholinghur had, on 13.05.2026 in Crl.MP.No.403 of 2026, directed him to stay at Sholinghur and report daily at 10.30 a.m., making compliance with both conditions impracticable. ORDER

This Criminal Original Petition has been filed seeking modification of the condition imposed upon the petitioner in paragraph (i) in Crl M.P. No.549 of 2026 dated 27-04-2026 on the file of the Judicial Magistrate, Ambattur that the petitioner/accused should execute a bond for a sum of Rs.10,000/- with two sureties for a like sum each and should appear before the respondent police daily at 10.00 a.m., for 15 days.

2. The learned counsel for the Petitioner submits that the he has got bail in another case in Cr.No.140 of 2025, wherein the learned Judicial Magistrate, Sholinghur has granted bail on certain conditions in Crl.MP.No.403 of 2026 on 13.05.2026 is that to stay at Sholinghur and appear before the respondent Police Station daily at 10.30 a.m., until further orders . It is the contention of the Petitioner that due to above order, it is difficult to comply the condition of the learned Judicial Magistrate, Ambattur passed in Crl.MP.No.549 of 2026 dated 27.04.2026. Hence, he seeks modification.

While perusing the order, the Order of the learned Judicial Magistrate, Ambattur is prior in point of time. Therefore, modifying the condition of the learned Judicial Magistrate, Ambattur for the sake of the condition imposed by
