The learned counsel for the Petitioner submits that this Criminal Miscellaneous Petition has been filed under Section 5 of the Limitation Act, 1963, seeking to condone the delay of 247 days in filing the criminal revision petition.

In view of the reasons stated in the affidavit filed in support of the condone delay petition, the reason appears to be convincing and genuine, the delay of 247 days in filing the above criminal revision petition is condoned.

Accordingly, the miscellaneous petition is ordered. The Office is directed to number the Crl.R.C. today itself and post the main case on 11.08.2026 ‘’for final disposal’’.

In the meantime, the respondent is directed to file counter in the main case within a period of four weeks. Two weeks time is granted to the learned counsel for the petitioner to file rejoinder to the counter affidavit.
