By order dated 10.06.2026 the Court had suspended for 30 days the sentence imposed on the petitioner (Vinith) in Spl.S.C.No.66 of 2019 (judgment dated 17.06.2025, learned Sessions Judge, Mahila Court, Perambalur) to enable registration of his marriage with the victim before the Registrar of Marriages, subject to reporting compliance. When the matter was heard, counsel for the petitioner alleged the victim and her mother were not cooperating with the marriage; the Government Advocate filed a status report with the victim's handwritten statement recording that after release on interim bail the petitioner changed his stand and refused to marry her despite attempts by her and the police. Holding that the petitioner failed to honour the undertaking given to the Court and breached the condition of suspension, the Court cancelled the 30-day interim suspension, directed the respondent police to take the petitioner into custody forthwith and hand him over to the Superintendent of Prison where he was detained to undergo the remaining period of sentence, and dismissed the petition.

Pursuant to the order passed by this Court on 10.06.2026, the

2. Today, when the matter was taken up for hearing, the learned counsel for the petitioner submitted that although the petitioner was ready to marry the victim, it was the victim and her mother who were not cooperating for the marriage.

3. Per contra, the learned Government Advocate strongly opposed the petitioner’s contention and filed a status report received from the Inspector of Police, Mangalamedu Police Station. It was submitted that the victim was enquired by the respondent police and had given a statement stating that, although the petitioner had represented before this Court that he was willing to marry her and take care of both the victim and the child, after his release on interim bail, he had completely changed his stand. Despite several attempts made by the victim and the police, the petitioner not come forward for the marriage instead became emboldened to state that he would not marry the victim, irrespective of the consequences. The handwritten statement given by the victim has been produced by the Inspector of Police, Mangalmedu All Women Police Station, is extracted hereunder:

4. In view of the above, this Court finds that the petitioner has failed

to honour the undertaking given before this Court and has breached the condition on which the sentence was suspended. Consequently, the interim suspension of sentence granted for a period of 30 days stands hereby cancelled. The respondent police are directed to take the petitioner into custody forthwith produce and handover to the Superintendent of Prison where he was detained, to undergo the remaining period of sentence.

5. Accordingly, this Criminal Miscellaneous Petition stands dismissed.
