This Criminal Miscellaneous Petition has been filed seeking relaxation of the condition imposed by this Court in Crl.M.P.No.21621 of 2025 in Crl.A.No.1759 of 2025 dated 24.11.2025.

2.The petitioner/accused in Spl.S.C.No.66 of 2022 was convicted by the trial Court by the judgment dated 30.10.2025. Aggrieved against the same, the petitioner filed an appeal before this Court in Crl.A.No.1759 of 2025 and suspension of sentence petition in Crl.M.P.No.21621 of 2025. This Court, by the order dated 24.11.2025, granted bail with certain conditions. One of the conditions was that the petitioner to appear before the respondent police on every Sunday at 10.30 a.m. and also to appear before the Trial Court on the first working day of every month at 10.30 a.m.

The learned counsel for the petitioner submitted that the petitioner is

the only bread winner of the family. Due to the above condition, he is unable to do any work. Further, appearing before the respondent police would serve no

purpose. The petitioner is ready to appear before the trial Court on the first working day of every month.

The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that the petitioner is complying with the conditions imposed by this Court without any deviation.

5.Considering the submissions made and on perusal of the materials and also considering the submission made by the learned Government Advocate that the petitioner is complying with the conditions without any deviation, the order dated 24.11.2025 made in Crl.M.P.No.21621 of 2025 in Crl.A.No.1759 of 2025 is modified to the effect that the condition to appear before the respondent police on every Sunday is set aside and the petitioner shall continue to appear before the trial Court on the first working day of every month at 10.30 a.m., till

the disposal of the criminal appeal. All other conditions remain unaltered.
