This Criminal Miscellaneous Petition has been filed seeking relaxation of the condition imposed by this Court in Crl.M.P.No.14680 of 2024 in Crl.A.No.1196 of 2023 dated 26.11.2025.

2.The petitioner/accused in Spl.S.C.No.53 of 2019 was convicted by the trial Court by the judgment dated 11.10.2022. Aggrieved against the same, the petitioner filed an appeal before this Court in Crl.A.No.1196 of 2023 and suspension of sentence petition in Crl.M.P.No.14680 of 2024. This Court, by

the order dated 26.11.2025, granted bail with certain conditions. One of the conditions was that the petitioner to appear before the respondent police on every Sunday at 10.30 a.m. and also to appear before the Trial Court on the first working day of every month at 10.30 a.m., till the disposal of the Criminal Appeal.

The learned counsel for the petitioner submitted that the petitioner is a daily wage earner and due to the condition imposed, he is unable to take any work and make his earnings. Further, appearing before the respondent police would serve no purpose. The petitioner is ready to appear before the trial Court on the first working day of every month.

The learned Government Advocate (Crl. Side) appearing for the

respondent police submitted that the petitioner is complying with the conditions imposed by this Court without any deviation.

5.Considering the submissions made and on perusal of the materials and also considering the submission made by the learned Government Advocate that the petitioner is complying with the conditions without any deviation, the order dated 26.11.2025 made in Crl.M.P.No.14680 of 2024 in Crl.A.No.1196 of 2023 is modified to the effect that the condition to appear before the respondent police on every Sunday is set aside and the petitioner shall continue to appear before the trial Court on the first working day of every month at 10.30 a.m., till the disposal of the criminal appeal. All other conditions remain unaltered.
