JUDGMENT

The appellant herein is the 1^st accused in Spl.S.C.No.28 of 2026 on the file of the learned III Additional District and Sessions Court (PCR), Madurai District. He was arrested and remanded to judicial custody on 19.11.2025, in connection with the crime No.560 of 2025 for the offence under Sections 191(2), 191(3), 49, 296(b), 118(1), 109(1), 351(3) of BNS and Sections 3(i)(r), 3(1)(s) and 3(2)(va) of SC/ST (POA) Act. The bail petition filed by the appellant was rejected by the trial Court, in Crl.M.P.No.222 of 2026, by order dated 01.07.2026. Aggrieved over the same, the appellant has preferred this appeal.

The learned counsel appearing for the appellant submits that except this appellant, all other accused have been released on bail. According to him, the appellant is in jail from 19.11.2025. Therefore, he seeks for grant of bail to the appellant. He further submits that the 2/7

appellant, in order to show his bona fide, is prepared to deposit some amount before the trial Court.

The learned Government Advocate (Crl. Side) submits that the

defacto complainant has raised certain issue with regard to the occupation of panchami lands and he has also filed a writ petition. For having filed a writ petition, the defacto complainant was assaulted by this appellant and others. The overt act as against this appellant is that he has called the defacto complainant to the place of occurrence and facilitated the commission of offence. Therefore, the learned Government Advocate opposed for grant of bail.

This Court considered the rival submissions made.

It is reported that except this appellant, all other accused have been granted bail either by the Sessions Court or by this Court. In this case, investigation was completed and final report has also been filed. Further, the appellant is also showing some indulgence to deposit some amount before the trial Court, in order to show his bona fide.

Considering the nature of injury and also the offer made by the appellant, this Court is inclined to grant bail to the appellant. Accordingly, this Criminal Appeal is allowed and the order dated 01.07.2026 made in Crl.M.P.No.222 of 2026 on the file of the III Additional District and Sessions Court (PCR), Madurai, is hereby set aside. The appellant is ordered to be released on bail on the following conditions:-

i) The appellant shall execute a bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties each for a like sum to the satisfaction of the learned III Additional District and Sessions Judge (PCR), Madurai.

ii) The appellant and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the Government in proof of their residence address; In the event, if there is any change of address, the same shall be intimated to the respondent Police without fail.

iii) The appellant shall deposit a sum of Rs.25,000/- (Rupees twenty five thousand only) to the credit of Crime No.560 of 2025 on the file of the III

Additional District Court for PCR, Madurai, without prejudice to his defence before the trial Court and on production of receipt, the concerned Magistrate shall accept the sureties furnished by the appellant. The trial Court shall permit the defacto complainant to withdraw the deposited amount, on filing a proper application.

iv) The appellant shall appear before the respondent Police daily at 10.30 a.m. until further orders.

v) The appellant shall not misuse the liberty granted to him by indulging in any further offence.

¶40

vi) On violation of any of the above conditions by the appellant, the respondent police shall move an application for cancellation of the bail.
