Heard the learned counsel for the petitioner.

Mr.D.Ramesh Kumar, learned counsel, appeared on behalf of respondent Nos.1 to 3.

The learned counsel for the petitioner submitted that the petitioner has already deposited the entire award amount, along with the accrued interest and costs, in M.C.O.P.No.390 of 2024 before the Special District Court, Thanjavur. To that effect, he has also filed an additional typed set of papers producing a copy of the deposit receipt.

The learned counsel for respondent Nos.1 to 3 conceded the

submission made by the learned counsel for the petitioner and prayed that respondent Nos.1 to 3 / claimants 1 to 3 may be permitted to withdraw 50% of the deposited amount.

The learned counsel for the petitioner submitted that the

admitted liability of Rs.18,20,000/- (Rupees Eighteen Lakhs and Twenty Thousand only) may be permitted to be withdrawn by the claimants.

In view of the fact that the petitioner has already deposited the

entire award amount, there shall be an order of stay till the disposal of the Civil Miscellaneous Appeal in C.M.A.(MD)No.253 of 2026.

Considering the facts and circumstances of the case, this Court is inclined to permit respondent Nos.1 to 3 / claimants 1 to 3 to withdraw the admitted liability of Rs.18,20,000/- (Rupees Eighteen Lakhs and Twenty Thousand only), along with the accrued interest and costs.
