PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the third respondent herein to consider the petitioner's proposal dated 05.02.2025 and pass appropriate orders to accord prior permission to fill up the post of B.T.Assistant (Tamil) and release the grant in aid to the Hindu Nadar Uravinmurai Committee Higher Secondary School, T.N.Pudhukudi, Puliyankudi, Tenkasi District within a time stipulated by this Court.

This Writ Petition has been filed seeking a writ of mandamus directing the third respondent to consider the petitioner's proposal, dated 05.02.2025 and

pass appropriate orders to accord prior permission to fill up the post of B.T.Assistant (Tamil) and release the grant in aid to the petitioner School.

2. The petitioner is an aided Higher Secondary School governed by Tamil Nadu Recognized Private Schools (Regulation) Act, 1973. The B.T.Assistant (Tamil) is a sanctioned post with cadre strength of four, wherein one Mr.T.Murugesan was appointed and thereafter, he superannuated on 31.01.2020 from service. Hence, the said sanctioned post was fell vacant from 01.02.2020.

The School committee passed a resolution to fill up the said vacancy after obtaining prior permission from the competent authority. Pursuant to the same, the School submitted a proposal on 05.02.2025 with a request to accord prior permission to fill up the said vacancy. The same was pending before the third respondent for consideration.

3. The learned Additional Government Pleader appearing for the respondents submits that the proposal sent by the petitioner will be considered in accordance with law within a time stipulated by this Court.

Having considered the facts and circumstances of the case and the submissions made by the respective learned counsels, in my considered view, this writ petition can be disposed of at the admission stage with the consent of both parties without going into the merits of the case with a direction to the third respondent to consider the proposal sent by the petitioner on 05.02.2025 to

fill up the post of B.T.Assistant (Tamil) and pass appropriate orders within a stipulated time to meet the ends of justice.
