complete the construction of the public toilet complexes, which was is halfway constructed, in R.S.No.46 in Vasudevanallur within Vasudevanallur Town Panchayat, Sivagiri Taluk, Tenkasi District, with modern amenities and good hygienic condition with 24 hours water supply, in the light of the observation made, by this Court, in its order in WP(MD)No.4914 of 2018 dated 08.03.2018 within a time frame fixed by this Court.

On 26.09.2025, we passed the following order:

“2.This is the third Writ Petition filed in regard to the public toilet stated to be on Government poramboke pathway in R.S.No.46 in Vasudevanallur within Vasudevanallur Town Panchayat, Sivagiri Taluk, Tenkasi District. Two Writ Petitions had been filed, both by M.Vellammal in W.P(MD)No.4914 of 2018 and W.P(MD)No.18481 of 2023, forbearing the respondents from constructing the toilet/shifting the toilets to an alternate construction.

3.In W.P(MD)No.4914 of 2018, by an order dated 08.03.2018, the Court has disposed the Writ Petition noting that the toilet complex was already constructed and is in disuse. The

Court has also recorded the submission of the learned Additional Government Pleader to the effect that nearly Rs.2 lakhs had been spent on renovation of the old toilet complex, though the Court notes that the photographs did not show signs of any renovation. Ultimately, the Writ Petition was disposed, directing the respondents to ensure that the old complex was properly maintained.

4.W.P(MD)No.18481 of 2023 was disposed on 27.03.2024, recording the submissions of the respondents that no toilet would be constructed in the above survey number.

5.The present Writ Petition seeks a Mandamus directing the respondents to complete the construction of the same toilet complex, which, according to the petitioner, is only partly constructed.
