PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to remove the encroachments as per the proceedings of the respondent No.2 vide Mo.Mu.No.P2/248/2025 dated 26.02.2025 made on the areas and the roads which are all situated at Pammanendal, P.Karisalkulam Village, Kamuthi Taluk, Ramanathapuram District in respect of Survey Nos.236, 328/2, 206/18 and 154 and also remove the encroachments in the adjacent lands which are all belongs to the Government by considering the petitioner's representation dated 11.08.2025.

(Order of the Court was made by DR.ANITA SUMANTH, J.)

We had, on 26.09.2025, passed the following order:

“ Mr.M.Sarangan, learned Additional Government Pleader accepts notice for R1 to R4 and Mr.J.Ashok, learned Additional Government Pleader accepts notice for R5.

2.The prayer for a Mandamus directing the respondents to remove the encroachments in and around Pammanendal, P.Karisalkulam Village, Kamuthi Taluk, Ramanathapuram District, in respect of Survey Nos.236, 328/2, 206/18 and 154.

3.As far as Survey Nos.236 and 154 are concerned, they have been identified to be encroachments on Kanmoi and Mr.Sarangan, states that the assistance of the PWD will be obtained to clear the same.

4.As far as Survey No.328/2 is concerned, it is stated to be a street, in respect of which Tahsildar will take necessary steps.

5.As far as Survey No.206/18 is concerned, it is yet to be ascertained as to whether there is any encroachment on that property, which comprises Natham land.

6.Let the aforesaid submissions be reduced into writing by R4.

2.Today, a report is filed by the Tahsildar, Kamuthi, Ramanathapuram District.

3.The key points which emerge from the report are that 16

encroachments have been identified, out of which, 10 have been identified in water bodies, two on a Government poramboke street in Survey No.328/2 and four have been identified on Natham land in Survey No.206/18.

4.The Sub-Collector, Paramakudi, Ramanathapuram District had, as early as on 26.02.2025, directed the Tahsildar as well as Block Development Officer of Kamuthi, Ramanathapuram District, to take necessary action for the removal of encroachments and necessary action in terms of Section 7 of the Tamil Nadu Land Encroachment Act, 1905 are stated to have been initiated as against the encroachers. Some of them had refused to receive the notices and the same have been affixed. Others have filed objections, that are under consideration.

6.As far as encroachments on Natham land are concerned,

Mr.Sarangan, submits that the State is authorized to issue patta if such encroachments do not otherwise obstruct or disturb public rights.

7.A reading of the status report dated Nil, September 2025 indicates that the action is underway for the removal of encroachments and sixteen (16) weeks time is sought for completion of the process and granted to the authorities.

8.In order to enable proper action to be taken, the Executive Officer, Public Works Department, Kamuthi, is suo motu impleaded as R6 and Mr.M.Sarangan, learned Additional Government Pleader accepts
