This Writ Petition has been filed for a Mandamus seeking for a direction to the respondents 2 to 4 to pass necessary orders directing the fifth respondent to refund the deposited amount of Rs.1,37,032/- with interest based on the petitioner's representation dated 31.12.2021, within a time frame to be fixed by this Court.

2. The petitioner claims that in view of the surcharge order passed in favour of the petitioner, the petitioner is entitled for refund of a sum of Rs.1,37,032/- from the fifth respondent society. The surcharge order passed in favour of the petitioner is also placed on record. The petitioner has given a representation on 31.12.2021 seeking for refund of the sum of Rs.1,37,032/-, together with interest from the fifth respondent society. Since the same has not been considered, she has filed this Writ Petition.

3. A counter affidavit has been filed by the respondents stating that in view of the pending legal proceedings, the amount need not be refunded to the petitioner. However, it is now brought to the notice of this Court by the learned Counsel for the petitioner that the surcharge order passed in favour of the petitioner has now attained finality by the dismissal of the Civil Revision Petition.

4. This Court is not expressing any opinion on the merits of the petitioner's representation. No prejudice will be caused to the respondents if the representation of the petitioner as stated supra is directed to be considered on merits and in accordance with law by the respondents within a time frame to be fixed by this Court.

For the foregoing reasons, this Writ Petition is disposed of, by directing the fifth respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 31.12.2021, seeking for refund of a sum of Rs.1,37,032/- together with interest within a period of twelve [12] weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
