Petition under Article 226 seeking a writ of mandamus against the District Collector and the Revenue Divisional Officer, Theni, to disburse 60% of the fishery lease amount to the petitioner's Sangam (G.Jeyaram, President, Meenakshiamman Kanmoi Neerinai Payanpaduthuvor Sangam) as per G.O.Ms.No.72 of the Public Works Department dated 06.05.2014. The Kanmoi (S.No.220, 86.12 hectares, Ammapatti/Meenakshipuram village, Bodinayakanur Taluk, Theni District), used by more than 500 farmers, had its fishery rights auctioned on 26.06.2025 and leased to Abdul Samath for 2025-2028; a representation dated 17.07.2025 seeking the disbursal for maintenance and strengthening of irrigation infrastructure went unconsidered. This writ petition has been filed by the petitioner seeking for mandamus directing the respondents 1 and 2 to disburse 60% of the fishery lease amount to their 'Meenakshiamman Kanmoi Neerinai Payanpaduthuvor Sangam' as per the G.O.Ms.No.72 of the Public Works Department dated 06.05.2014.

Heard the learned counsel appearing for the petitioner and Mrs.D.Farjana Ghoushia, learned Special Government Pleader, who takes notice on behalf of the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.

The case of the petitioner is that he is the President of Meenakshiamman Kanmoi Neerinai Payanpaduthuvor Sangam and that the said Kanmoi is situated in S.No.220 to an extent of 86.12 hectares at Meenakshipuram, Ammapatti Village, Bodinayakanur Taluk, Theni District and it is used by more than 500 farmers for cultivation. The fishery rights of the said Kanmoi were auctioned for lease on 26.06.2025 and pursuant to the same, the lease was given to one Abdul Samath for a period of three years from 2025 to 2028. Subsequently, for the purpose of maintenance and strengthening of irrigation infrastructure, the petitioner submitted a representation on 17.07.2025 to the respondents seeking disbursal of 60% of the fishery lease amount from 50% of the lease amount deposited by lease holder to the said Kanmoi in the light of G.O.Ms.No.72 of Public Works Department dated 06.05.2014. However, the same has not been considered so far. Hence, this petition.

The learned Special Government Pleader, on instructions, would submit that based on the G.O.Ms.No.72 of Public Works Department dated 06.05.2014, the respondents 4 and 5 will disburse the amount to the petitioner within one month.
