PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondent No.1 to issue Patta in favor of the petitioner name in respect of the S.No.47/1 at Balakrishnapuram Village, Dindigul East Taluk, Dindigul District based on his representation dated 26.03.2025 and 04.07.2025.

representations dated 26.03.2025 and 04.07.2025 requesting for patta, the present Writ Petition has been filed.

Learned Special Government Pleader accepts notice for the sole respondent. He has placed on record an order dated 14.03.2025 of the Hon'ble Division Bench of this Court in W.P.(MD) No.6839 of 2025 (J.Sabarish Satindra and another vs. The District Collector, Dindigul and others) directing the official respondents therein to consider the representation of the petitioner therein for removal of encroachment in survey No.47/1 Balakrishnapuram village. Learned Special Government Pleader submits that the petitioner's request for patta relates to the same survey number.

In response to this, learned counsel for the petitioner submits that the revenue officials inspected the petitioner's property and stated orally that it is away from the highways.

In view of these submissions, it becomes necessary to first ascertain whether the whole of survey No.47/1 is classified as Highways.
