This writ petition has been filed challenging the impugned proceedings of the 1 st respondent vide Na.Ka.No.1216/2024/KaVa dated 30.06.2025 insofar as it imposes conditions III and IV on the petitioner and consequently to direct the respondents to disburse all the retirement benefits legally due to the petitioner, including gratuity, provident fund, leave encashment by considering the representation of the petitioner dated 25.07.2025 along with interest at the rate fixed by this Court from the date when it became due till payment.

2. The petitioner retired from service as the Secretary of the third

respondent society on 30.06.2025. However, he has been relieved from service with certain conditions, which reads as follows:-

3. Aforesaid conditions (III) and (IV) are onerous one. If any decree is obtained by the third respondent society either through the petitioner or other officer, which is a continuous cause of action, subsequent officer will ensure for execution of the same. The loans in respect of the members of the society has to be collected by the subsequent officer, since the loan was sanctioned only by the petitioner, who was holding the post of Secretary in the third respondent society.

4. The learned Special Government Pleader appearing for the respondents 1 and 2 fairly submits that for the conditions (III) and (IV), only the subsequent officer can enforce the same and hence, the conditions (III) and (IV) may be set aside and other conditions may be intact.

5. Considering the facts and circumstances of this case, the conditions (iii) and (iv) imposed on the petitioner vide the impugned order are quashed and this writ petition is allowed. This will not stand in the way of recovery from the petitioner by the third respondent in respect of other two conditions. The other conditions imposed upon the

petitioner under the impugned order dated 30.06.2025 are intact. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
