PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records relating to the impugned proceedings O.Mu.Na.Ka.No.12622/E1/2019 dated 28.07.2020 of the third respondent and Na.Ka.No. 4304/A5/2020 dated .08.2020 signed on 19.08.2020 of the fourth respondent and quash the same and consequently direct the respondents 1 to 4 to permit the fifth respondent school to convert the post of BT Assistant Social Science that fell vacant on 01.06.2019 on account of retirement of Incumbent NS.Jeyaseeli, as the Post of BT Assistant Maths.

This writ petition has been filed challenging the impugned orders dated 27.07.2020 and 19.08.2020 passed by the third and fourth respondents respectively, rejecting the proposal sent by the fifth respondent School seeking conversion of the post from B.T. Assistant (History) to B.T. Assistant (Maths).

The learned counsel appearing for the fifth respondent has now placed

on record before this Court the approval granted to a teacher, by name, Tmt.M.A.Flora Backiya Seeli, for the post of B.T. Assistant (History) in the fifth respondent School. He would submit that since under the impugned order, 2/6

the request for conversion made by the fifth respondent school from B.T. Assistant (History) to B.T. Assistant (Maths) has been rejected, the fifth respondent accepted the said order and thereafter, submitted a proposal in favour of Tmt.M.A.Flora Backiya Seeli for being appointed in the fifth respondent School as B.T. Assistant (History) and the said proposal was also approved by the third respondent by its proceedings dated 15.05.2025.

In view of the approval granted in favour of Tmt.M.A.Flora Backiya Seeli, arising out of the very same vacancy for which the present writ petition has been filed, though for a different subject, for which the sanction has also been granted, the petitioner will have to necessarily challenge the proceedings of the third respondent dated 15.05.2025, through which Tmt.M.A.Flora Backiya Seeli appointed as B.T. Assistant (History) in the fifth respondent School has been approved. Therefore, in this writ petition no relief can be granted in favour of the petitioner.

Since already the approval has been granted in favour of Tmt.M.A.Flora Backiya Seeli for being appointed as B.T. Assistant (History) in the fifth respondent School, the learned counsel seeks liberty for the petitioner to challenge the proceedings dated 15.05.2025 of the third respondent under 3/6

which, the proposal seeking for appointment of Tmt.M.A.Flora Backiya Seeli as B.T. Assistant (History) in the fifth respondent School has been approved. Necessarily, such a liberty will have to be granted to protect the interest, if any, of the petitioner.

Accordingly, this writ petition is disposed of, after recording the aforesaid facts, by granting liberty to the petitioner to challenge the proceedings dated 15.05.2025 of the third respondent, approving the appointment of Tmt.M.A.Flora Backiya Seeli as B.T. Assistant (History) in the fifth respondent School, in the manner known to the petitioner under law. No costs. Consequently, the connected miscellaneous petitions are closed.
