These writ petitions are filed seeking a direction to remove the unauthroized constructions put up in the subject property. One writ petition is filed by the mother and other writ petition is filed by the son seeking the same relief.

2.The sixth respondent, Tahsildar filled a counter affidavit. As per the counter affidavit, it is brought to the notice of this Court that the lands in Survey Nos.256/1, 2A, 257/3B, 4, 5 are all classified as Adidhravidar Natham and house site assignments have been issued in the year 1985 itself. There are about 200 families belonging to the Adi Dravidar community residing in the village and there is an old Pillayar Temple constructed within the premises and the old temple has been renovated. The Authorities are also conducted an inspection on 28.06.2025 and on enquiry it reveals that the entire people are co-operating for the renovation of the temple by making contribution. Renovation is at the final stage. Therefore, there is no unauthorized construction as projected by the petitioners.

05. I respectfully submit that for the sake of brevity, the history of the case is narrated as detailed below:

The land in SF.No. SF.No. 256/1, 2A, 257/3B, 4, and 5 in, Kuppakudi village, Alangudi Taluk, Pudukkottai District are classified as Adi dravidar Natham and house sit assignment were given in the year 1985. The lands in SF. 257/4 and 5 were set apart for public purposes. Adidravidar houses were located in SF.No. 256/2A, 257/3B and 257/4, SF.No. 256/1 extent 00185 Sq.meters set apart for Public purposes and in SF.No. 257/5 extent 00411 sq.meters Water Tank(OHT), Mini water Tank, Open Auditorium, Community Hall and the old Pillayar temple under Banyan tree exist and the temple which was in dilapidated condition and endanger to the worshipers was demolished and new pillaiyar temple constructed in the same place and the same is at final stage. There are about 200 families of Adi Dravidars are residing in the village and the land set apart for public purpose has not been occupied. The temple was constructed after demolishing the old building with the help of Adi Dravidar families residing in this village. I inspected the place on 28.06.2025 and my enquiry reveals that the entire people co-operating for the construction of the temple and constributing for the same. The temple construction is at finishing stage.

4.In view of the fact that the there is no unauthorized constructions and already there is an old temple constructed by the villagers in the lands provided by

the Government, the relief sought for by the writ petitioners cannot be granted.

5.In view of the above deliberations, the writ petitions stand dismissed. No costs.
