PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the first respondent to grant permission for locating the Dina Thanthi See Paa Athithanar Memorial Auto Stand at opposite to Thinathanthi Office Bharathiar Salai Junction, Railway Station Road, at Trichy on the basis of our representation dated 05.05.2023, within the time stipulated by this Court.

The petitioner has preferred this Writ Petition seeking for a direction to the first respondent to grant permission for locating the Dina Thanthi See Paa Athithanar Memorial Auto Stand, opposite to Thinathanthi Office, Bharathiar Salai Junction, Railway Station Road, at Trichy, on the basis of the petitioners' representation dated 05.05.2023.

2 . Learned Counsel for the petitioners would submit that for the purpose of locating the auto stand opposite to the Thinathanthi Office at Bharathiar Salai Junction, Railway Station Road, Trichy, the petitioners have already given a common representation dated 05.05.2023. However, till date, the said representation has not been considered by the respondents. Hence, the present Writ Petition has been filed.

Learned Special Government Pleader appearing for the second respondent would submit on instructions that the land in which the petitioners seek for locating the auto stand belongs to the Highways Department and therefore, the respondents are not in a position to allot the said land for locating the auto stand.

4 . In reply to the said submission made by the learned Special Government Pleader appearing for the second respondent, the learned Counsel for the petitioners would submit that the petitioners have already filed an impleading application, seeking to implead the Highways Department.

5 . Heard the submissions made by the learned Counsel on either side.

Admittedly, the land belongs to the Highways department and therefore, the right course available to the petitioners is to approach the officials of the Highways department for redressal of their grievance. Though it is claimed that impleading petition has been filed by the petitioner seeking to implead the Highways Department, since no representation has been sent to the Highways department it is not proper for this Court to direct the Highways department to consider their representation. Therefore, this Court does not find any merit in this Writ Petition.

7 . Accordingly, this Writ Petition stands dismissed, with liberty to the petitioners to approach the Highways Department in the manner known to law. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
