Prayer: Writ Petition is filed under Article 226 of the Constitution of India, in the nature of a Writ of Mandamus, directing the respondent to pay the petitioner the amount payable towards the encashment of 78.5 days of earned leaves surrendered by her deceased husband/employee(Late) S.Natarajan, Staff No.86TH2004 in the years before his death, either based on his monthly wages of the respective months of surrender of those earned leaves, together with 18% interest p.a. from the respective due dates or based on the monthly wages payable to him on the month of his death, together with 18 interest from the date of his death, within a time frame as may be fixed by this Court.

The present Writ Petition has been filed by a wife of deceased employee (Technical Level -5) of the respondent Corporation, seeking disbursement of the earned leave and surrender leave salary along with interest.

Though the petitioner's husband has died on 17.07.2017 while in service, the earned leave and surrender leave salary have not been disbursed to the writ petitioner, despite giving representation to the respondent on 02.04.2025 for disbursing the said benefits. Since the representation has not been considered, the present writ petition has been filed.

3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondent.

Considering the above said facts, the respondent herein is directed to release the eligible earned leave and surrender leave salary upon the writ petitioner along with interest at the rate of 6% p.a., from the due date till the date of disbursement, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said observations, this Writ Petition stands disposed of. No costs.
