2. According to the petitioner, the first FIR in Crime No.304 of 2022 was registered against the petitioner on 20.10.2022 for the offence under Section 381 of IPC alleging that the petitioner who was working in the defacto complainant's house, along with other accused committed theft of costly watches, Camera, Laptop etc. and during the course of enquiry, his mobile phone was seized by the police and it was under the custody of the police. While so, on 04.12.2022, the second FIR in Crime No.353 of 2022 was registered against the petitioner based on the complaint of the very same defacto complainant wherein the 6 th and 7 th respondents/Police are alleged to have recorded confession statement from the petitioner and seized a mobile phone from the petitioner which was already available with the police. The contention of the learned counsel for the petitioner is that the petitioner has been falsely implicated in the second FIR by fabrication of records and pursuant to the second FIR, the petitioner was also arrested.
