This Criminal Original Petition is filed to call for the records relating to

the FIR in Crime No.178/2023 on the file of the Inspector of Police, Team-11,

Bank Fraud Investigation, Central Crime Branch, Chennai and Quash the same.

The petitioner was the defacto complainant and he is the bank manager. According to him, A.1 and A.2 created certain documents and mortgaged the documents and availed loan and the loan has become Non-performing Asset,

hence FIR has been filed against A.1 and A.2 and without any materials, the

¶25

petitioner has been implicated as A.3.

¶26

Now, it is the contention of the learned Additional Public Prosecutor

¶27

appearing for the 1st respondent that during the investigation, it revealed that

A.3 also colluded with A.1 and A.2 and there are materials against A.3 that he

used to collect 1% commission for sanctioning the loan. That apart, even prior

¶33

to the sale in favour of A.1, the property was inspected by A.3, therefore he was

¶34

also made an accused and arrested. Further, gold chain was also recovered from

¶35

A.3, which was given as a gift for sanctioning the loan.

Considering the above said facts and circumstances of the case, at this

¶37

stage, FIR cannot be quashed. It is no doubt true that petitioner was not made

¶38

as an accused in the FIR and only during the investigation, the petitioner was

¶39

made as an accused. At any event, FIR should continue for investigation

¶40

against A.1 and A.2, therefore, FIR cannot be quashed. If at all any materials collected against the petitioner / A.3 in the final report, liberty is granted to the petitioner to challenge the final report.

Accordingly, the present Petition is dismissed. Consequently, connected miscellaneous petition is closed.
