Prayer in W.P.No.9174 of 2025 : Writ petition filed under Article 226 of the Constitution of India, for the issuance of a Writ of Certiorarified Mandamus, calling for the records from the second respondent herein pertaining to his impugned order dated 23.06.2023 made in Na.Ka.No.3015/Aa3/2022 and quash the same and direct the respondent Nos.2 and 3 to remove/entries made in their books pertaining to the petitioner's sale deed dated 18.06.2014, registered as Doc.No.932 of 2014 at the Joint Sub Registration Office No.1, Tindivanam for purchase of Plot No.10 measuring 1264 square feet (117.42 square meter), out of the lands measuring 77 cents, comprised in Survey No.6/3 from N.Ravi, represented by its General Power Agent M.Muthu (the 5th respondent herein) and to pass orders.

COMMON ORDER

The subject matter of challenge in both these writ petitions pertains to

the proceedings of the second respondent dated 23.06.2023, wherein the registered sale deeds came to be cancelled in exercise of power under Section 77 A of the Registration Act.

Heard Mr.T.Dhanasekaran, learned counsel for the petitioners, Mr.U.Baranidharan, learned Special Government Pleader, for R1 to R3 and Mr.E.Kannadasan, learned counsel for R4.

It is seen from records that the 5th respondent in these writ petitions already filed W.P.No.4363 of 2024, challenging the proceedings of the second respondent, dated 23.06.2023. The writ petition was disposed of by an order, dated 22.02.2024, and the order passed by the District Registrar was set aside and the parties were directed to work out their remedy before the competent civil court.

It is also brought to the notice of the Court that the fourth respondent has already filed a suit in OS No.201 of 2024 before the I Additional District Munsif Court, Tindivanam and the said suit is pending.

In the light of the above development, taking note of the earlier

order passed in W.P.No.4363 of 2024 dated 22.02.2024, this Court holds that the order passed by the second respondent dated 23.06.2023 has already been set aside and the same is recorded and it is left open to the fourth respondent to work out her remedy in the pending suit.
