It is averred that the petitioner is the absolute owner of the property

W.P. No.27693 of 2025 situated at New Colony, Koovathur, in Gramam Natham bearing New S. No.764/19, Old S. No.95/3, which he inherited from his ancestors. Originally, the land is Gramam Natham land, and patta was issued by the revenue authorities in favour of Thulakanam, who is petitioner’s grandmother, to a certain extent under Patta No.286. After the demise of Thulakanam, the property devolved upon the petitioner's father Chellappan and his paternal uncle Elumalai. Subsequently, Elumalai executed a Release Deed in favour of the petitioner's father. Thereafter, the petitioner's father executed a Settlement Deed in favour of the petitioner vide Document No.2427/2020 and thus, he is the absolute owner of the subject property and patta stands in his name.

It is further stated that even though a complaint was lodged against the petitioner before the 4^th respondent with respect to possession of the said property, the Villagers did not produce any documentary proof in support of their claim and thus, the 4^th respondent, after conducting enquiry came to the conclusion in favour of the petitioner. After several legal battles, it was confirmed that the petitioner is the lawful owner of the property. Later, he submitted an application to the respondents 1 to 3 seeking temporary electricity connection for carrying out construction activities in the said property. However, the 3^rd respondent did not effect electricity service connection citing objections raised by the Villagers. In such circumstances, challenging the rejection order dated 06.01.2025 issued by the 3^rd respondent, this writ petition 6/10

Learned counsel for the petitioner submitted that merely because some villagers have raised objections without producing any supporting documents and despite this Court having confirmed the petitioner's title, the respondents cannot refuse to effect temporary service connection. He further submitted that the petitioner, who is visually challenged, has already paid the requisite charges, and therefore denial of electricity service connection to the subject property of the petitioner by the 3^rd respondent, vide order dated 06.01.2025 is highly arbitrary and prayed for quashment of the same. Further, he sought consequential directions to the respondents 2 and 3 to provide electricity service connection to the petitioner’s property as per application dated 03.04.2024.

Learned Standing Counsel appearing for the respondents 1 to 3 submitted that though patta stands in the name of the petitioner, based on the objections and protest raised by the Villagers stating that the petitioner has obtained forged patta for the land which belongs to a Temple, electricity service connection was not provided to the subject property. He also submitted that consequent to rejection order, the respondents will refund the charges to the petitioner in respect of the aforesaid electricity connection. However, as the earlier application was sent through online process and rejected, the petitioner 7/10

W.P. No.27693 of 2025 has to submit a fresh application seeking electricity service connection. If such application is filed, the respondents will consider the same afresh in accordance with law, within a time frame to be fixed by this Court.

Heard the learned counsel on either side and perused the materials placed on record.

Considering the aforesaid submissions and taking note of the fact that patta and title documents stand in the name of the petitioner and without any documentary proof with regard to suspect of title, merely relying on the objections raised by Villagers / third parties, the respondents cannot withhold temporary electricity connection.

In view of the above, this Court, directs the petitioner to submit a fresh application to the respondents, through online portal, seeking electricity service connection with respect to the subject property along with necessary charges, within a period of two weeks from the date of receipt of a copy of this order. On such submission, the respondents 1 to 3 shall consider the petitioner’s application and effect temporary electricity service connection to the subject property of the petitioner, within a period of four weeks from the date of receipt of a copy of this order, provided the petitioner has complied with all formalities. It is made clear that if the earlier charges paid by the petitioner was not refunded to him, it is for the respondents either to refund the same or to adjust it for the

With the above directions, this writ petition stands disposed of. No
