Since the issue involved in both these writ petitions is related to one another, these writ petitions are disposed of by way of a common order.

Learned Standing Counsel appearing for the respondents submitted

that subsequent to interim order issued by this Court on 08.10.2021, the respondents have entered into an agreement with the petitioner on 01.06.2022

W.P. Nos.21346 of 2021 and 21358 of 2021 and 01.09.2022 respectively. Further, he has produced the details of calculation submitted by the respondents for the period from August 2020 to May 2022 and October 2020 to May 2022 in so far as Tirunelveli Distribution Circle and for the period from April 2021 to August 2022 insofar as Kanyakumari Distribution Circle respectively.

Acceding the said submission, learned counsel for the petitioner submitted that the wind energy level adjustment for interregnum period is available with the respondents, and this Court may issue directions to the respondents to adjust the same.

In response, learned Standing Counsel appearing for the respondents submitted that after due verification, the respondents will adjust the wind energy available in the petitioner’s account and therefore, this Court may issue appropriate directions in the above regard.

Recording the aforesaid submissions, this Court directs the respondents to adjust the wind energy available in the petitioner’s account after making due verification and pass orders on merits and in accordance with law, within a

period of eight weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner .
