The present writ petition has been filed to call for the records pertaining

to the impugned proceedings in Na.Ka.No. 551/2025/A2, dated 28.04.2025, on

the file of the 1st respondent, and to quash the same.

The case of the petitioner is that the 1st petitioner purchased the property from one G. Palayam, measuring an extent of 15 cents comprised in

Survey No. 61/15, situated at No.6, Anaikattucheri Village, Chrancheri Panchayat Village, Sriperumbudur Taluk, registered as Document No. 451 of 1996 on the file of the Sub-Registrar Office, Poonamallee. After registration of

the said property, all revenue records relating to the subject property were

transferred in the name of the 1st petitioner, and patta bearing No. 199 was also

¶34

issued in his favour.

¶35

While so, during February 2023, the 3rd respondent submitted a

¶36

petition before the respondents 1 and 2 claiming that her late husband, one

¶37

Arumugam, had a half share in the said property and requested cancellation of

¶38

the patta standing in the 1st petitioner’s name. Based on the said petition, the 1st respondent issued the impugned notice dated 07.05.2025 directing the petitioner

and the 3rd respondent to attend an enquiry. Aggrieved by the said notice, the

¶40

1st petitioner filed the present writ petition.

Heard both sides and perused the materials available on record.

The learned counsel for the petitioner submitted that the 1st petitioner,

A.G. Kuppusamy, who was the sole petitioner, passed away on 15.08.2025.

Although the petitioners contend that the 3rd respondent did not

¶45

produce any documentary evidence to substantiate her claim during the earlier

¶46

enquiries conducted by the 1st respondent on 04.03.2025 and 23.04.2025,

considering that the 1st petitioner, the sole patta holder has since expired, and

the 3rd respondent is challenging the patta issued in his favour, this Court is of

¶52

the view that it is necessary to afford an opportunity of hearing to the legal heirs

¶53

of the deceased 1st petitioner, who have been substituted as petitioners in this

¶54

writ petition pursuant to the order of this Court in W.M.P. No. 42598 of 2025 dated 22.10.2025. This Court finds no illegality or infirmity in the impugned

¶55

notice dated 07.05.2025 issued by the 1st respondent.

In view of the foregoing, the writ petition stands dismissed.

Consequently, connected Miscellaneous Petitions are closed. No costs. However, the 1st respondent is directed to complete the enquiry by affording sufficient opportunity to the substituted petitioners and other contesting parties

and to pass appropriate orders on merits and in accordance with law within a

¶59

period of twelve (12) weeks from the date of receipt of a copy of this order.
