The Writ of Mandamus has been instituted to direct the respondent to

consider the representation dated 08.06.2024 and consequently direct the 3rd

¶27

respondent to issue most backward class community certificate of the petitioner's daughter as “,ir ntshsu; ” in Tamil (ISAIVELLALAR in English)

instead of “,ir bts;shsu;”.

Mr. K. Sakthivel, learned counsel for the petitioner, would submit

¶30

that as per the Tamil Nadu Government Gazette published on 05.09.2008, the

¶31

notification relating to the list of Most Backward Classes, at Serial No. 9,

¶32

reveals that the name of the community as " Isaivellalar ".

The grievance of the petitioner is that, while issuing the community

¶36

certificate in Tamil, the authorities are stating as ",ir ntshsu;", since,

¶37

according to the petitioner, an error has been committed in the Government Gazette published in the English language.

When this Court raised a question about what would be the adverse

¶39

consequences in the event of such an error, the learned counsel for the petitioner

¶40

fairly submitted that it would not change the status of the community, since both

¶41

"Isai Vellalar" and "Isai Velalar" belong to the Most Backward Class

¶42

community.

¶43

In this context, the authorities are bound to issue community

¶44

certificates stating the community as mentioned in the Government Gazette in

¶45

both English and Tamil. There should not be any spelling mistake or change the

¶46

community certificate while mentioning the community of a person. Therefore,

¶47

the authorities are directed to ensure that community certificates are issued with

¶48

the correct name of the community as stated in the Government Gazette, and

¶49

any error could cause prejudice to the interest of the persons. If there is an error

¶52

in the certificate issued to the petitioner's daughter, the authorities may look into

¶53

the matter and rectify the error, if identified.

With these observations, the Writ Petition is disposed of. No costs.

Consequently, the connected Miscellaneous Petitions, if any, are closed.
