Though several grounds have been raised in the Writ Appeal, challenging the order passed in the Writ Petition, the learned counsel appearing for the workman would submit that if an enhanced compensation is awarded, apart from permitting him to withdraw the amount which has already been deposited to the credit of I.D.No.317 of 2009, before the III Additional Labour Court, Chennai, by the Management, he would be satisfied.

2.When this Court suggested that a sum of Rs.2,00,000/- would be justifiable as a lumpsum compensation, both the counsels had agreed to the same. Incidentally, the Management had already deposited a sum of Rs.1,40,785/- to the credit of I.D.No.317 of 2009 before the III Additional Labour Court, Chennai, on 10.03.2015.

3.The appellant herein is at liberty to file an appropriate application before the concerned Labour Court, seeking for withdrawal

of the entire amount along with the accrued interest.

4.Whenever, such an application is made by the appellant, the III

Additional Labour Court shall endeavor to pass appropriate orders atleast within a period of one (1) week from the date of reciept of the application.

5.The Management shall pay the balance of the lumpsum compensation amounting to Rs.60,000/- to the appellant, within a period of four (4) weeks from the date of receipt of copy of this order.

6.This Writ Appeal stands disposed of accordingly. No costs. Consequently, the connected miscellaneous petition is closed.
