Today, the matter is listed under the caption “For Being Mentioned” at

the instance of the learned counsel for the plaintiff.

When the matter is taken up for hearing the learned counsel for the plaintiff submitted that on 10.12.2025 he sought permission of this Court to dismiss the suit with liberty to file a fresh suit and he has also made an endorsement to that effect, however in the Judgment dated 10.12.2025, it has been stated that this Civil suit is dismissed as withdrawn. Therefore, the said typographical error has to be corrected.

This Court also perused the Judgment dated 10.12.2025 and the endorsement made by the learned counsel for the plaintiff. As per the endorsement made by the plaintiff, he has sought permission of this Court to dismiss the suit with liberty to file a fresh suit. However, in the Judgment “liberty to file a fresh suit” has not been mentioned. Therefore, it is appropriate to correct the above typographical error. Hence, the Registry is directed to carry out the correction in the second paragraph of the order “as the suit is dismissed as withdrawn with liberty to file a fresh suit” and issue the corrected copy of the
