This Civil Revision Petition has bee filed to set aside the order dated 03.07.2023 passed in IA No.3 of 2022 in OS No.5585 of 2011 on the file of XVI Assistant City Civil Court, Chennai.

Today, when the matter is taken up for hearing, the learned counsel for

the petitioner seeks permission of this Court to withdraw this civil revision petition and he has also made an endorsement to that effect. He further submitted that liberty may be given to the petitioner to file a fresh civil revision petition after restoration of the said suit, since the suit came to be dismissed for

default.

Learned counsel appearing for the respondents7 to 12 submitted that

without verifying the stage of the case, the petitioner had obtained interim stay

before this Court. Thereafter, the interim stay was extended on three occassions.

In view of the submission made by the learned counsel on either side,

this Civil Revision Petition is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is closed.
