ORDER

¶19

The petitioners, who were arrested and remanded to judicial custody on

27.10.2025, for the alleged offence punishable under Sections 191(2), 192(3), 125, 296(b), 109, 351(3) of BNS, in Crime No.726 of 2025, on the file of the respondent police, seeks bail.

The case of the prosecution is that on 27.10.2025 at about 12.15 AM near Madhuravoyal Alapakkam Road near GR Mobile Shop, due to previous enmity, the petitioners along with other accused waylaid and abused the defacto complainant in filthy language and assaulted him with knife, he sustained grievous injuries, admitted in hospital and later discharged, based on the complaint, FIR was registered, the petitioners were arrested on 27.10.2025.

Learned counsel appearing for the petitioners submitted that the petitioners are an innocent, they have been falsely implicated in this case and the counter case is also lodged by the petitioners herein. He would further submit that the petitioners was arrested and they are in judicial custody from 27.10.2025 and ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioners.

police submitted that the investigation is not completed in this case, final report is also filed and yet to be taken on file, the petitioners are not having any previous cases and he opposed for grant of bail to the petitioners.

Heard both sides and perused the materials available on record including the First Information Report.

Considering the submissions of the learned counsel on either side and the period of incarceration from 27.10.2025, the petitioners are not having any previous cases, and this Court is inclined to grant bail to the petitioners, subject to certain conditions.

Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial

Magistrate-II at Poonamallee, and on further conditions that:-

[a] the sureties shall affix their photographs and Left

Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their

[b] the petitioners shall report before the Judicial Magistrate-II, Poonamallee daily at 05.00 p.m., for a period of

three weeks;

[c] the petitioners shall not abscond either during investigation or trial;

[d] the petitioners shall not tamper with the evidence or witness either during investigation or trial;

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme

[f] If the accused thereafter absconds, a fresh FIR can be
